Industry’s trade association delivers coordinated, data-driven response to significant EB-5 rulemaking announcement

Washington, DC, Sept. 01, 2026 (GLOBE NEWSWIRE) -- Invest In the USA (IIUSA), the voice of the EB-5 Regional Center Program, submitted more than 150 pages of formal comments to the Department of Homeland Security in response to the July 2, 2026 Notice of Proposed Rulemaking (NPRM) governing the EB-5 Immigrant Investor Program. IIUSA’s comprehensive submission is the result of a coordinated industry response, reflecting nearly two months of rigorous analysis, member engagement, and collaboration across the EB-5 ecosystem. Invest In the USA (IIUSA) is the national membership-based 501(c)(6) not-for-profit trade association for the EB-5 Regional Center Program.

IIUSA’s comments reflect the collective expertise and on-the-ground experience of our membership, including regional centers, immigration attorneys, economic development professionals, and other stakeholders who are committed to a strong, well-regulated, and effective EB-5 program. Upon publication of the NPRM on July 2, IIUSA immediately mobilized its membership and leadership to conduct a thorough review of the proposed rule’s 358 pages. Recognizing the breadth and complexity of the rulemaking, IIUSA organized its response effort into 11 working groups under the umbrella of its Public Policy Committee, each focused on a distinct area of the proposed rule. Working groups were composed of more than 45 IIUSA Board members, legal experts, regional center operators, economists, and other industry professionals with direct experience in their respective areas.

IIUSA’s submission addresses the full scope of the proposed rule and covers such topics as:

·         Definitions and Scope of "Person Involved" and "Affiliated Job-Creating Entity"

·         Bona Fides, Biometrics, and Attestation Requirements

·         Sanctions, Enforcement, and Proportionality

·         Promoter Regulation and Securities Law Compliance

·         Fraud, Misrepresentation, Deceit, and Criminal Misuse

·         Targeted Employment Areas, Job Creation, and Economic Methodology

·         National Interest Determinations and Pre-RIA Obligations

·         Capital, Investment, and Infrastructure

·         Removal of Conditions and I-829 Process

 

The working group structure allowed IIUSA to analyze every significant provision of the proposed rule in depth, identify areas of concern, develop substantive recommendations, and draft comments that are specific, well-reasoned, and grounded in real-world experience and program data. In addition to the working group's efforts, IIUSA solicited member data to ensure that its comments are supported by quantitative evidence drawn directly from the industry’s experience operating under the existing regulatory framework.
